Terms of Service

These terms govern your use of the SetMind website (setmind.com.au) and any psychiatric services booked through SetMind Pty Ltd (ABN 60 696 170 395). By using our website or booking an appointment, you agree to these terms.

1. Who we are

SetMind is an Australian telepsychiatry clinic for adults. Care is provided by independent consultant psychiatrists who consult through the SetMind platform. SetMind operates the clinic, booking systems, and patient administration.

2. Eligibility

Our services are for adults aged 18 and over, physically present in Australia at the time of consultation. You must hold a valid referral from a GP or eligible medical specialist to claim Medicare rebates. We do not provide emergency or crisis care — if you are in immediate danger, call 000 or Lifeline on 13 11 14.

3. Bookings, fees, and cancellations

  • Fees for each consultation type are published on our Fees page and confirmed at booking.
  • Payment is taken at the time of consultation via our secure payment provider.
  • Medicare rebates (where eligible) are processed on your behalf and paid to your nominated bank account by Services Australia.
  • Cancellations made with less than 24 hours' notice, or non-attendance, may incur a fee equal to up to 100% of the consultation fee. Medicare does not rebate cancellation fees.

4. Telehealth — what to expect

Consultations are conducted by secure video. You are responsible for ensuring you have a private, quiet space and a reliable internet connection. If the video connection fails, your psychiatrist may continue by telephone at their discretion.

5. Clinical scope and limitations

SetMind psychiatrists provide assessment, diagnostic clarification, medication review, and ongoing shared-care management. We do not provide:

  • Emergency, crisis, or after-hours care
  • Care for patients under 18
  • Medico-legal reports, custody assessments, or insurance assessments
  • NDIS eligibility assessments
  • Inpatient admission or involuntary treatment

Where your clinical needs fall outside our scope, we will help you and your GP identify an appropriate alternative pathway.

6. Prescribing

Prescribing decisions are at the clinical discretion of your psychiatrist. SetMind specialists comply with PBS, TGA, and state authority requirements. Schedule 8 medications (including stimulants) are prescribed under strict regulatory frameworks and may not be appropriate at a first appointment.

7. Communication and records

With your consent, a summary of each consultation is sent to your nominated GP. Records are kept in accordance with our Privacy Policy and applicable health records legislation.

8. Website use

Content on setmind.com.au is for general information only and does not constitute medical advice. Always consult a qualified clinician about your individual circumstances. We make reasonable efforts to keep information current but provide no warranty as to accuracy or completeness.

9. Liability

To the extent permitted by law, SetMind's liability for any claim arising out of your use of our website or services is limited to the supply of the relevant service again or the cost of doing so. Nothing in these terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Governing law

These terms are governed by the laws of New South Wales, Australia.
