Privacy Policy

SetMind Pty Ltd (ABN 60 696 170 395) ("SetMind", "we", "us", "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, hold, use, and disclose your personal and health information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and applicable state and territory health records legislation.

1. What we collect

We collect information necessary to provide safe and effective psychiatric care, including:

  • Identity and contact details (name, date of birth, address, email, phone)
  • Medicare, DVA, NDIS, and private health insurance details
  • GP and referrer details
  • Health information — medical history, medications, mental health history, assessment results, clinical notes, correspondence
  • Payment information (processed by our payment provider; we do not store full card numbers)
  • Technical information when you use our website (IP address, browser, pages visited)

2. How we collect it

We collect information directly from you (via our booking platform, intake forms, and consultations), from your referring GP or specialist, and where relevant from Medicare, your health fund, pathology providers, or other treating clinicians — with your consent.

3. Why we collect it

We use your information to:

  • Provide psychiatric assessment, treatment, and ongoing care
  • Communicate with your GP and other treating clinicians
  • Process Medicare, DVA, and insurance claims
  • Manage appointments, billing, and our clinic operations
  • Meet our legal, regulatory, and professional obligations (including AHPRA, Medicare, and PBS requirements)
  • Improve our services and respond to feedback

4. Who we share it with

We disclose your information only when necessary, including to:

  • Your nominated GP and other treating clinicians
  • Medicare, DVA, PBS, and your private health fund (for claiming)
  • Our secure clinical software providers (Halaxy and equivalent), bound by confidentiality and Australian privacy law
  • Pathology and imaging providers when you require investigations
  • Regulators or courts where required by law (e.g. subpoena, mandatory reporting, public safety)

We do not sell your personal or health information. We do not disclose it for marketing purposes.

5. Storage and security

Your records are stored in secure, access-controlled clinical systems hosted in Australia. We use encryption in transit, role-based access controls, and audit logging. SetMind treats adults only (18+). Clinical records are retained for the period required by law — generally seven years from the date of last contact.

6. Accessing and correcting your information

You may request access to, or correction of, your personal and health information at any time by emailing hello@setmind.com.au. We will respond within 30 days. Identity verification is required before any record is released.

7. Overseas disclosure

Our primary clinical and email systems store data in Australia. Some supporting tools (e.g. website analytics, secure file transfer) may process limited data overseas. Where this occurs we take reasonable steps to ensure those providers handle your information consistently with the APPs.
